High hedges consultation launched

Environment Minister Edwin Poots today announced the launch of a public consultation on a draft High Hedges Bill.

This Bill is designed to help people adversely affected by high hedges bordering their domestic property.

The Minister explained how the legislation will operate: ”If after discussion with the hedge owner, a reasonable agreement can’t be reached on the height of the hedge, this draft legislation provides a means whereby a complaint can be taken to a council. The council will decide on the issue and if appropriate issue a remedial notice requiring the hedge to be reduced to a reasonable height.

“A similar system has been operating in England and Wales for some time and I feel should work well in Northern Ireland. Of course I will be very keen to hear views on the draft legislation so that I can consider them and would encourage those who are interested to send responses to my Department.”

Public consultation In Northern Ireland on the draft High Hedges Bill will run until 1 March 2010.

  2. In England and Wales, high hedges legislation is contained in Part 8 of the Anti Social behaviour Act 2003. The provision gives local authorities powers to deal with complaints about high hedges which are having an adverse effect on a neighbour’s enjoyment of his property.
