Co Antrim farmer fined for polluting discharge to a waterway

A Co Tyrone lorry driver was fined a total of £200 for breaches of waste management legislation.

Mr Samuel David Cooper, 36, of Stewart Avenue, Cookstown, pleaded guilty to two charges under The Waste and Contaminated Land (Northern Ireland) Order 1997 at Dungannon Magistrates’ court today.

On 11th July 2007, PSNI officers found Mr Cooper unloading approximately 100 lorry tyres from an articulated lorry onto a bonfire at a playground off Killymoon Street, Cookstown. The PSNI notified the Northern Ireland Environment Agency (previously the Environment and Heritage Service).

Mr Cooper would have been charged £1,000 to dispose of the tyres legally.

1. Mr Cooper was fined £100 on each of the following charges:

Article 4(1)a of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charges relate to depositing of controlled waste in or on land unless a waste management licence authorising the deposit is in force and the deposit in accordance with the licence.

Article 4(1)c of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related disposing of controlled waste in a manner likely to cause pollution of the environment or harm to human health.
