Ballykinlar man fined £900 for illegal waste offences

A Co Down man was today fined a total of £900 plus £31 court costs at Newry Magistrates’ Court for the illegal disposal of tyres.

Mr Leonard Nicholson of Shore Road, Ballykinlar, was found guilty of six charges brought under The Waste and Contaminated Land (Northern Ireland) Order 1997 and was fined £150 on each charge.

In September and October 2008, officials from the Northern Ireland Environment Agency (NIEA), in conjunction with officers from Newry and Mourne District Council, investigated Mr Nicholson in relation to the illegal disposal of tyres on a bonfire in Newry.

1. Mr Nicholson was found guilty on two charges each under the following charges under the Waste and Contaminated Land Order (Northern Ireland) 1997:

Article 4 (1) a – depositing and knowingly permitting waste to be deposited in or on land without a waste management licence;

Article 4(1) b - relating to keeping controlled waste in or on land unless a waste management licence authorising the deposit is in force and the deposit in accordance with the licence.

Article 4 (1) c - relating to the disposal of controlled waste in a manner likely to cause damage to the environment or human health.
