04 February 2010 - Farmer convicted at Dungannon Court

Mr Michael Kelly, Loughbracken Road, Pomeroy, Co Tyrone, was convicted at Dungannon Magistrates’ Court on 4 February 2010 of one charge under the Tuberculosis (Examination and Testing) Scheme Order (Northern Ireland) 1999.

Mr Kelly was convicted in his absence and fined £1,500.

  1. Mr Kelly was convicted of one charge, of contravening Article 3(2) (b) of the Tuberculosis (Examination and Testing) Scheme Order (NI) 1999, in that being the keeper of animals, namely cattle, failed upon request by an authorised officer of the Department of Agriculture, to present all such animals in his charge for tuberculosis testing, contrary to Article 52 (1) (a) of the Disease of Animals (NI) Order 1981.
  2. The control of Bovine Tuberculosis (TB) is dependent on identifying reactor animals at tests conducted by the Department. Failure to present animals for tests seriously undermines efforts by both farmers and the Department to reduce the incidence of disease.
