11 August 2008 - Future provision of legal services to the Health and Social Care service

Legal services to the Health and Social Care (HSC) service will, in future, be provided in house by the Central Services Agency (CSA).

The CSA provides support services to the DHSSPS, the four health Boards, and five HSC Trusts and agencies.

Health Minister, Michael McGimpsey said: “Legal services had previously been provided by both the CSA and a number of private legal firms. However a decision was taken by Direct Rule Ministers that these services would be subject to a further competitive tendering exercise which was expected to take place during 2008/09.

“This process has now been stood down as I have decided that in future all HSC bodies should seek legal advice from the Directorate of Legal Services (DLS) within the CSA. The DLS has recognised experience and legal expertise in all areas of law, specifically specialist areas such as clinical negligence and personal social services.

“In addition, it has the capacity to handle large numbers of referrals economically and with no potential conflict of interest and will simplify administrative arrangements for Boards and Trusts.”

Any health and social care organisations currently using a private legal firm will be expected to move its legal work to CSA under arrangements and timescales to be agreed.
