05 September 2008 - North Antrim car breaker fined £600 for waste offences

A Co Antrim car breaker was fined a total of £600 at Coleraine Magistrates’ court today for breaches of waste management legislation.

Mr Hill Smith (58) of Drones Road, Armoy Co Antrim received the fine after pleading guilty to two waste charges under the Waste and Contaminated Land (Northern Ireland) Order 1997.

On 29 March 2007, officers from the Environment and Heritage Service (the predecessor of the Northern Ireland Environment Agency) investigated a site at Drones Road, Armoy owned by Mr Smith, where a substantial quantity of controlled wastes, in the form of end of life vehicles (ELVs) and parts of end of life vehicles, was deposited.

The site did not have a licence to operate as an Authorised Treatment Facility for ELVs.

Officers estimated that around 175 ELVs were on site at the time of the visit. They revisited the site, which still did not have a waste management licence, on 14 August 2007 and observed the controlled waste was still on site.

Mr Smith was fined £300 on each waste charge and was also ordered to pay court costs of £145.

He was fined under Article 4(1) b of The Waste and Contaminated Land (Northern Ireland) Order 1997.

  1. End of Life Vehicles are defined as vehicles that are categorized as waste. Waste is defined as anything that you discard, intend to discard or are required to discard.
