Environment and Heritage Service officials (now the Northern Ireland Environment Agency) visited the site on a number of occasions between 14 May 2007 and 14 February 2008 in response to complaints of unauthorised waste disposal where they observed deposits of controlled waste consisting of mixed construction and demolition material. The site had no waste management authorisation in place.

1. Mr Hannon pleaded guilty to the charges and was fined £100 for each, under the following Articles of the Waste & Contaminated Land (Northern Ireland) Order 1997:
Article 4(1)(a) Between 13 May 2007 and 16 May 2007, depositing controlled waste, or knowingly causing or knowingly permitting controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence.
Article 4(1)(a) Between 17 May 2007 and 7 June 2007, depositing controlled waste, or knowingly causing or knowingly permitting controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence.
Article 4(1)(a) Between 8 June 2007 and 25 August 2007, depositing controlled waste, or knowingly causing or knowingly permitting controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence.
Article 4(1)(a) Between 26 August 2007 and 15 February 2008, depositing controlled waste, or knowingly causing or knowingly permitting controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence. Article 4(1)(b) Between 19 June 2007 and 15 February 2008, treating, keeping or disposing of controlled waste, or knowingly causing or knowingly permitting controlled waste to be treated, kept or disposed of
(i) in or on any land, or (ii) by means of any mobile plant except under and in accordance with a waste management licence.
