On 18 August 2005, in response to complaints of unauthorised waste disposal, officers from the Environment and Heritage Service (now the Northern Ireland Environment Agency) visited a site at Magheralane Road, Ballymena, where they witnessed the disposal of controlled waste consisting of clay, soil and demolition waste.
An investigation by the Construction Contractor Monitoring (CCM) established the waste material originated from the demolition site of the former Camphill Primary School, Toome Road, Ballymena. No waste management licence or exemption was in force.
Mr Tanner pleaded guilty and was fined £100 on eight waste charges, plus court costs of £100.

This was a joint investigation with Construction Contractor Monitoring and NIEA. CCM is a government body tasked with monitoring government contracts to ensure they are fulfilled within a legal framework.
The charges related to breaches of the following Articles of the Waste & Contaminated Land (Northern Ireland) Order 1997:
4(1)(a) deposit controlled waste, or knowingly cause or knowingly permit controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence:
5(1)(c) on transfer of the waste, to secure-
(ii) That there is transferred such a written description of the waste as will enable other persons to avoid a contravention of that Article and to comply with this paragraph as respects the escape of waste.
