12 December 2007 - Silverbridge man gets suspended sentence for illegal dumping

Kevin Reel (41), of New Road, Silverbridge, Newry, was given a three-month suspended sentence at Armagh Magistrates’ Court yesterday for breaches of waste management legislation.

Following reports of illegal dumping at a site off the New Road, Silverbridge, Environment and Heritage Service officers carried out a survey in May 2005. This revealed waste buried under clay including electrical equipment, household waste, chemical containers and construction and demolition waste. One sample was later identified as asbestos. It was estimated that upwards of 8,775 tonnes of waste had been deposited. On 31st May 2005 an Article 27 Notice was issued for the removal of the waste. The site had no waste management authorisations.

EHS estimated the level of landfill tax avoidance for the waste deposits as upwards of £157,950.

Mr Reel pleaded guilty to three charges under the Waste and Contaminated Land (NI) Order 1997 and received a three-month suspended sentence for each offence.

The offences included:

  1. Article 4(1)a of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to knowingly permitting controlled waste to be deposited in or on land without there being in force a waste management licence on a date unknown between 26 November 2003 and 11th May 2005.
  2. Article 4(1)b of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to knowingly permitting controlled waste to be kept or treated in or on land except or in accordance wit a waste management licence on a date unknown between 26 November 2003 and 11th May 2005.
  3. Article 4(1)c of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to keeping controlled waste in a manner likely to cause pollution of the environment or harm to human health on a date unknown between 3 December 2000 and 11th May 2005.
