27 February 2008 - Landowner and construction firm fined for illegal waste disposal

Landowner, Marietta McKavanagh (57), of Derryola Bridge Road, Aghalee, was fined £2,250 at Craigavon Magistrates Court today for illegal waste disposal.

Riverside Construction (Down) Ltd, of Bridge Street, Banbridge, was also fined £500 at the same court for two offences under the Waste and Contaminated Land (NI) Order 1997.

Environment and Heritage Service (EHS) officers found controlled waste deposited at the Derryola Bridge Road site. This included clay, construction and demolition waste, wood, timber and plastics. This land was registered to Mrs McKavanagh and was not authorised to accept any waste material.

The material deposited on the site originated from renovation work at a store in Portadown. Riverside Construction was responsible for the waste removal from this site. On 28 June 2007, an Article 27 Notice requiring the landowner, Mrs McKavanagh, to remove the waste was issued. On a follow-up visit on 24 August 2007 EHS officers observed that the notice had not been complied with.

Mrs McKavanagh was charged under Article 4(1)(a) for depositing controlled waste, Article 4(1)(b) keeping controlled waste and Article 27(2) failure to remove controlled waste in accordance with a notice served contrary to Article 27(5) of the Waste and Contaminated Land Order 1997. She was fined £750 for each charge.

Riverside Construction (Down) Ltd was charged under Article 5(1)(a) for failing to take measures to prevent contravention of Article 4 and Article 5(1)(c)(i) for failure to ensure that transfer of waste is only to an authorised person contrary to Article 5(8) of the Waste and Contaminated Land Order 1997. They were fined £750 for each charge.
