Mr John Leo Carey (63), Cloghague Road, Toomebridge, pleaded guilty and was fined £3,000 on each charge.
On 15 June 2006 and 6 July 2006 officers of the Northern Ireland Environment Agency (NIEA), (formerly the Environment and Heritage Service) visited a site located on the Cloghogue Road, Toomebridge, in response to complaints of unauthorised waste disposal.
On 6 June 2008 an intrusive survey was carried out by NIEA officers who observed approximately 5,400 tonnes of controlled waste.

1. The charges related to breaches of the following Articles of the Waste & Contaminated Land (Northern Ireland) Order 1997
4(1)(a) deposit controlled waste, or knowingly cause or knowingly permit controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence: and
4(1)(b) treat, keep or dispose of controlled waste, or knowingly cause or knowingly permit controlled waste to be treated, kept or disposed of
(i) in or on any land, or
(ii) by means of any mobile plant
except under and in accordance with a waste management licence.
