Lisbellaw vehicle breaker fined for waste offences
Tuesday, 10 February 2009A Co Fermanagh vehicle breaker was fined a total of £250 and given a conditional discharge suspended for 12 months at Enniskillen Magistrates’ court today.
Philip Carson (55) of Belfast Road, Lisbellaw, pleaded guilty to two charges of breaches of waste management legislation.
On 23 November 2007, officers from the Northern Ireland Environment Agency (formerly the Environment and Heritage Service) investigated a site at Leambreslin, Lisbellaw, owned by Mr Carson where approximately 400 end of life vehicles (ELV) and parts of end of life vehicles were deposited without a licence to operate as an authorised treatment facility.
Officers visited the site again on 26 February 2008 and found this waste still on site.

1. The charges were brought under The Waste and Contaminated Land (Northern Ireland) Order 1997.
Mr Carson was fined £250 under Article 4(1)a and given a conditional discharge suspended for 12 months under Article 4(1)b.
4(1)(a) deposit controlled waste, or knowingly cause or knowingly permit controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence: and
4(1)(b) treat, keep or dispose of controlled waste, or knowingly cause or knowingly permit controlled waste to be treated, kept or disposed of
(i) in or on any land, or
(ii) by means of any mobile plant
except under and in accordance with a waste management licence.
2. End of Life Vehicles are defined as vehicles that are categorised as waste. Waste is defined as anything that you discard, intend to discard or are required to discard.
3. The charges related to depositing, treating, keeping and disposal of controlled waste, or knowingly causing or knowingly permitting controlled waste to be deposited, treated, kept or disposed of in or on any land except under and in accordance with a waste management licence.
