07 November 2007 - Limavady window display breaks planning law

Douglas Miller of ‘The Lodge', 1 Main Street, Limavady, was fined today at Limavady Magistrates' Court for breaching a Planning Enforcement Notice.

Mr Miller submitted an application for the retention of a glass display on the first floor of his property at 41-47 Market Street Limavady but this was subsequently refused planning permission.

An enforcement notice was served on Mr Miller on 18 April 2007 requiring the permanent removal of the glass display case and the permanent closure of the resulting opening reinstated to match the existing building. Mr Miller was given 56 days to meet the terms but the notice was not complied with during the specified time and a summons was served.

The Planning Service brought the action under Article 72 of the Planning (NI) Order 1991(as amended)

Mr Miller was fined £150 and £97 costs.
