12 October 2007 - Castlederg company fined for waste offences

Castlederg building contractors R J .McKelvey Ltd was found guilty of breaches of waste management legislation at Omagh Magistrates’ court today.

On 23 March 2006, Environment and Heritage Service officers investigated complaints of illegal waste dumped at Crocknacor Road, Cloughfin, Omagh, where a lorry was tipping builders’ rubble and clay on an area 40m x 40m and 2m deep.

R.J.McKelvey Ltd pleaded guilty to two charges and was fined a total of £500 (£100 and £400 for each charge) plus court costs of £55, under The Waste and Contaminated Land Order (NI) 1997, relating to the keeping of controlled waste on the land without a waste management licence.

The company was fined under the following Articles of The Waste and Contaminated Land (Northern Ireland) Order 1997, (i) Article 4(1)a, relating to the deposit of controlled waste, or knowingly causing or permitting controlled waste to be deposited in or on land unless a waste management licence authorising the deposit is in force and the deposit in accordance with the licence; and (ii) Article 5(1)(a), on the grounds of failure to take all such measures applicable in that capacity as are reasonable in the circumstances to prevent any contravention by any other person of Article 4.
