Environment and Heritage Service officers investigated a dump site owned by Mr Lyons on Crevenagh Road on 6 April and 18 May 2004. The waste on the site included tyres, plastic bags, silage wrap, food packaging, automotive parts, newspapers, decaying food stuff and partly decomposed animals. Some of the domestic waste deposited on the site was identified as originating from Cork and Wexford.
Mr Lyons pleaded guilty to five waste charges. In addition to the £5,000 fine, he was further sentenced to a term of 9 months imprisonment suspended for 12 months.

Mr Lyons was fined £1,000 for each offence under the following Articles of The Waste and Contaminated Land (Northern Ireland) Order 1997 Article 4(1)(a): the charge relates to the deposit of controlled waste, or knowingly permitting controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence, between 26 November 2003 and 19 May 2004. Article 4(1)(b): the charge relates to treating, keeping or disposing of controlled waste, or knowingly causing or permitting controlled waste to be treated, kept or disposed of in or on any land except under and in accordance with a waste management licence, on 6 April 2004.
