On 23 March 2006 Environment and Heritage Service officers investigated complaints of illegal waste deposit, on the Crocknacor Road, Omagh. The officers found a lorry tipping builders waste on an area 40m x 40m and 2m deep.
Mr McAleer pleaded guilty to two charges and was fined £1,000 on each charge plus court costs of £55, under The Waste and Contaminated Land Order (NI) 1997.

Article 4(1)b of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to keeping controlled waste in or on land unless a waste management licence authorising the deposit is in force and the deposit in accordance with the licence.
Article 4(1)a of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to the deposit of controlled waste, or knowingly causing or knowingly permitting controlled waste to be deposited in or on land unless a waste management licence authorising the deposit is in force and the deposit in accordance with the licence.
The controlled waste was builder’s rubble, clay, scrap metal, plastics and burnt materials.
