Vehicle breaker fined £3,000 for waste offences

Mr Roy Hamilton (53) of Kildoag Road, Killaloo, Londonderry, was yesterday fined a total of £3,000 at Londonderry Magistrates’ Court for breaches of waste legislation.

Officers of the Northern Ireland Environment Agency investigated a site at 152a Kildoag Road, Killaloo, Londonderry, owned by Mr Hamilton on 19 October 2007 where a substantial quantity of controlled wastes in the form of end of life vehicles and parts of end of life vehicles was deposited. Most of the vehicles were Heavy Goods Vehicles.

The site did not have a waste management licence or a licence to operate as an authorised treatment facility for end of life vehicles. Officers returned to the site on

19 November 2008 and noted an increase in the amount of scrap vehicles on site. There was no license or exemption on this date.

Mr Hamilton pleaded guilty on three waste charges under The Waste and Contaminated Land (Northern Ireland) Order 1997 and was fined £1,000 under Article 4(1)a, £1,000 under Article 4(1)b and £1,000 under 4(1)b of The Waste and Contaminated Land (Northern Ireland) Order 1997 with court costs of £175.

1. End of Life Vehicles are defined as vehicles that are categorized as waste. Waste is defined as anything that you discard, intend to discard or are required to discard.
